1. About us
agnesdavis.com ("the Site") is operated by Agnes Davis, trading as "Agnes Davis" ("we", "us", "our"), a sole trader based in the United Kingdom. These terms govern your use of the Site and any purchase you make from us.
2. Using the Site
By using the Site, you confirm that you're at least 18 years old, or using the Site under the supervision of a parent or guardian. You agree to use the Site only for lawful purposes and not to misuse it in any way, including attempting to gain unauthorised access to it or interfering with its operation.
3. Our products
We sell original paintings and drawings, canvas prints, limited edition fine art prints, and gift cards. We try to describe and photograph all artwork as accurately as possible, but colours may appear slightly different depending on your screen, and — because original artworks are handmade and unique — there may be minor variations from photographs. Reproduction prints, especially where resized, will differ from the originals due to the processes involved in creating reproductions. We have tried to match the images as closely as possible, but please be aware that variations will naturally occur. Limited edition prints are produced in the numbered edition size stated on the product listing; once an edition sells out, it will not be reprinted under this edition again.
Canvas prints and limited edition fine art prints are produced to order and shipped by our print fulfilment partners — currently Printumo and CreativeHub — on our behalf. Original paintings and drawings are shipped directly by us. 4. Prices and payment
All prices on the Site are shown in GBP (£). We reserve the right to change prices at any time, but changes won't affect orders you've already placed. Payment is taken securely at checkout via our website platform's payment processing; we do not store your full card details.
5. Orders and contract formation
When you place an order, we'll send you an order confirmation email — this confirms we've received your order, but the contract between us is only formed when we confirm the item is dispatched (or, for made-to-order prints, when production begins). We reserve the right to decline or cancel an order — for example, if an item is no longer available, there's an error in the price or description, or we suspect fraud. If this happens, we'll notify you and refund any payment already taken.

8. Intellectual property
All artwork, images, photographs, text, and content on the Site are the copyright of Agnes Davis unless otherwise stated, and may not be copied, reproduced, or used without our prior written permission. Purchasing an original artwork or print does not transfer copyright in the underlying artwork to you — you are buying the physical piece, not the right to reproduce the image.
9. Limitation of liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under English law. Subject to that, we won't be liable for any indirect or consequential loss arising from your use of the Site or purchase of our products, and our total liability to you for any claim will be limited to the amount you paid for the relevant order.
10. Gift cards
Gift cards are valid for 2 years from the date of purchase, can be used towards any purchase on the Site, and are non-refundable once purchased, except where required by law.
11. Changes to these terms
We may update these terms from time to time to reflect changes in our business or the law. The version in force at the time you place an order is the one that applies to that order.
12. Governing law
These terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
